The Need of a Comprehensive Legal Framework for Human Rights Protection of the Climate Change Displaced People (CDP): Bangladesh Perspective

Climate change not only impacts on the physical and geological environments of the earth but also directly and intensely impacts the lives and livelihoods of the people. The uncontrolled and unplanned movement of people might cause significant human rights suffering. Both voluntary and forced human displacement due to unfavourable climate conditions creates significant human rights violations because people choose this as their last option for adaptation.

It is estimated that between 2008 and 2014, 4.7 million people were displaced due to disasters in Bangladesh and by 2050, one in every 7 people in Bangladesh will be displaced by climate change. Therefore, human rights of the people are profoundly affected by the climate change in Bangladesh.

International and national legal and normative frameworks do not protect the rights of the CDP because they are the new category of involuntary migrants. Moreover, CDP are not aware about their human rights which are usually affected due to climate change. On the other hand, the government of Bangladesh does not bear any responsibility to protect CDP due to lack of any legal mandate. Therefore, a comprehensive legal framework is required to protect human rights of the CDP in Bangladesh.

The aim of the presentation is to propose various features of a legal framework which might act as a model for the government of Bangladesh for effective management of the CDP if they want to introduce any legal framework for the CDP in future. It will also indicate the kind of changes that should be introduced to the existing climate change displacement regimes in Bangladesh. The findings of the presentation would suggest how to bridge the gap between the government of Bangladesh and CDP to enforce their human rights.
